New Jersey Birth Injury Lawyers

One of the happiest moments in a person’s life can occur at the time of the birth of their child. However, the mother and child alike need focused and attentive care throughout the labor and delivery process. Almost 4 million births occur in the US each year, and each family expects that the doctors, residents, nurses, and other healthcare professionals assisting in the birth of their child have the training and experience to make the proper decisions during the course of labor and delivery. Unfortunately, mistakes happen, and those mistakes can have serious and even catastrophic consequences for the baby.

At Cerussi & Gunn, P.C., we represent families during the most difficult times following a birth injury, providing guidance and experience to help you and your family through. The New Jersey birth injury lawyers at Cerussi & Gunn, P.C., have a reputation for proven results in these cases.

Causes of Birth Injury

A birth injury can be caused by many things, some of the most common are medical malpractice issues such as:

  • Failure to perform a C-section in a timely fashion
  • Failing to recognize fetal distress during labor
  • Failure to use or improper use of techniques to assist in the delivery of the baby
  • Use of excessive force during the delivery of the baby

Types of Birth Injuries

If the appropriate decisions are not made during the labor and delivery of a baby, serious neurological and physical injury can occur. Common birth injuries due to medical malpractice are:

  • Hypoxia – A medical condition that occurs when a part of the body has its oxygen and/or blood supply cut off, thus causing cell death and damage to the affected area. Also referred to as hypoxic ischemic encephalopathy (HIE).
  • Cerebral Palsy – A medical disorder that affects the brain’s motor controls. It has three subtypes:
    • Spastic – Stiffness and trouble moving body parts
    • Athetoid – Involuntary or uncontrollable movement of limbs
    • Ataxic – Problems with balance, depth-perception, and walking
  • Brachial Plexus Injury – Injury to the arm, which causes weakness in the arm, the inability to use certain muscles in the arm, and sometimes paralysis of the arm.
    • Erb’s Palsy – Type of brachial plexus injury that affects the nerves of the upper arm, which can include loss of feeling or weakness in the affected arm or even total paralysis
    • Klumpke’s Palsy – Type of brachial plexus injury that affects the nerves of the lower arm, fingers, and wrist, which usually results in total paralysis
  • Shoulder Dystocia – An injury that occurs during delivery where the infant’s head and shoulders get caught behind the mother’s pelvic bone. This complication is dangerous to both mother and child, as the mother can end up with maternal hemorrhaging and uterine ruptures, while the child may end up with a collarbone or brachial plexus fracture, trouble breathing, cerebral palsy or even death.

If your child has suffered injury or death as a result of medical malpractice during labor and delivery, we can provide you with quality legal guidance. Medical malpractice is a challenging area of law and the prosecution of medical malpractice cases, in general, should be handled by law firms such as ours, that have the skill, experience, and resources to properly investigate and, if the case is appropriately supported by qualified medical experts, to pursue the case.
